Assalamu Alaikum,

Some well known Muslim Scholars in …………… have given Fatwa that it is not right for Muslims to live in non Muslim countries unless it is ONLY for Dawah (spreading Islam).

What are your thoughts on this topic, what we as women can do about this, shall we ask our families to relocate back?

ANSWER

Assalamu Alaikum,

Alhamdulillah, thank you for your question. We Muslims are told to follow the examples of our Prophet (peace be upon him), to the best of our capabilities. In Surah Al-Ahzab 33-21, Allah the Almighty says;"Indeed in the Messenger of Allah (peace be upon him) you have a excellent example to follow, for those who hope in meeting with Allah and the Last Day and remember Allah a lot". Having said that let us look what the Prophet (peace be upon him) did in the same situation.

It is a historical fact that Makkah has been the center of worship of one Allah even before the evident of Islam, and always held the significance and respect. Makkah is also the birthplace of our Prophet (peace be upon him) but when it became difficult for the Prophet (peace be upon him) and others to survive, practice and preach their faith in Makkah, they migrated to an unknown but more peaceful place called “Yathrib” (means "abandoned", today’s Medina Al-Munnawarrah) a place that had no religious significance at the time. This very act of migration is one of the most significant landmarks of the life of our Prophet (peace be upon him) it changed the history, provided freedom, various opportunities and started the new Islamic calendar.

I would not hesitate to say that those who say that Muslims must not live in a non-Muslim country, lack or only have superficial knowledge of Islam, teaching of Glorious Qura’n and the traditions (Sunnah) of the Prophet (peace be upon him). Are "Non-Muslim" majority countries are created (Astaghfirullah) by someone other than Allah? Are environment for human rights, earning through the lawful means, peace, human rights, freedom of speech and practice suitable for Muslims in "so-called" Muslim countries?

In Surah An-Nisa (4:97-100), Allah The Almighty says; "Verily! As for those whom the angels of death come upon while they are wronging themselves (as they stayed among the wrong doers even though emigration was obligatory for them under those conditions), the angels say to them: "In what (condition) were you in your life?" They reply: "We were weak and oppressed on earth." The angels would say: "Was not the earth of Allah spacious enough for you to emigrate therein?" Such men will find their abode in Hell - What an evil destination! Except the weak ones among men, women and children who cannot devise a plan, nor are they have means. For those there is hope that Allah will forgive them, and Allah is Ever Oft Pardoning, Oft-Forgiving. He who emigrates (from his home) in the Cause of Allah, will find on earth many dwelling places and plenty to live by……"

According to these ayat and the practice of the Prophet (peace be upon him) Muslims are directed to migrate to places where they could peacefully practice their faith and earn livelihood, as that question will be asked of them at the time of death, "……why didn’t you migrate to a more peaceful place where you could have practiced your obligations to Allah." I honestly believe that an overwhelming majority of people migrating to other countries are doing so for the sake of better opportunities to live, earn, learn, educate their children and also freely practice their obligations.

May I question the understanding of those "Scholars" about spreading Islam? Islam is very much spread by the proper personal practice, attitude and behavior not by a "fully paid trip to the West" for few days for the scholars. It is a fact that Muslim living in the non-Muslim majority countries in the East, West, North and or South have more rights than those who live in "Muslim World."

In my opinion, in most cases if Muslims face difficulties in a non-Muslim environment, is because of their own lack of understanding and practice of Islam, their sectarian mentality, culture that has nothing to do with Islam, internal discrimination based on class, countries of origin, language, lack of unity, ancestry, false pride, desire of control, tolerance of each other, attitude of all the Political and overwhelming majority of the religious leadership, etc. We Muslims are supposed to practice what we preach or do what we say we believe.

Needless to say that as long as we live on this planet we are not in the Paradise in a perfect "nothing could go wrong" environment. Things do go wrong or mistaken but concerns can be expressed, addressed or corrected, can these "Scholars" say the same about any Muslim Country?

There are many who may say or think that the laws of their new country of residence (by choice) place no restrictions on them as they are made by non-Muslims. Entering into a country is like signing a “contract to be law obedient”, I have not seen or heard of any law of Europe or USA where a Muslims is forced to do something against Islam.

A prominent scholar and Jurist Dr. Shaikh Salman Al-Oadah says that; “The Muslims living in a non-Muslim country are living in their adopted country under a covenant (pleadge, oath). They must, therefore, comply with the laws of their country of residence without disobeying Islamic Law. A Muslim is not to break or violate oaths, laws or promises. He will not be a true faithful Muslim if he does.”

For example, in Surah Al-Maidah (Ayah 1), Allah the Almighty says:“Oh you who believe! Fulfill your obligations (promises, oaths, pledges).”

In Surah Al-Isra (Ayah 34); “And fulfill every covenant. Verily! The covenant (promises, oaths, pledges) will be questioned about.”

In Surah Al-Nahal (Ayah 91); “And fulfill the Covenant to Allah when you have covenanted, and break not the oaths after you have confirmed them.”

Among the characteristics of a hypocrite is that the Prophet (peace be upon him): “…when he speaks he lies, acts treacherously toward covenants (promises, oaths, pledges), and when entrusted, he betrays.”

Muslim must set an example by character, behavior and practice of Islamic teachings, MUST avoid whatever contradicts and leaves a wrong impression of Islam on others. Muslim living in non-Muslim countries have greater responsibility as they are the living examples of Islam and Islamic teachings, their practice of Islam is a continuous “invitation of Islam” to all.

Muslims living, educating and earning in non-Muslim countries and practicing Islamic teachings themselves, are spreading Islam. They are instrumental for others to see Islam in practice.

Muslim women have an equal even greater responsibility to practice Islam in a non-Muslim environment. Muslim women should not hesitate to tell someone that they are Muslims (when asked). Give correct knowledge of Islam to the children which is not limited to recitation or memorizing few Surah of Qura’n, but also “knowledge through example” by parents, and putting the Islamic learning to practice. Please remember that life is a journey, and to reach the destination, one must have to have the correct direction. Each and every journey starts with a single first step; take the first step to be a role model and a positive example for your children and others around you. You will be preaching Islam by practicing it properly in morals, dress, food, prayers, attitude, approach, habits, rituals, and every aspect of life, etc.

To conclude, those who argue that Muslims should not live in a non-Muslim country and should immigrate to a Muslim country MUST also tell us which Muslim country to migrate to, where we could live in a peaceful Islamic environment and enjoy equal rights as others. Do they consider Pakistan , Afghanistan , Saudi Arabia , Palestine, Somalia, Sudan, Nigeria, Egypt, etc to be that “Islamic Country” that people should migrate to?

Muslim individual or families could live in a non-Muslim country as long as they are free to practice their religious obligations, duties, respect the rules and regulations of their country of residence.
Finally, here are two Ahadith from our beloved Prophet (peace be upon him);

Narrated by Ibn Hibban that the Prophet (peace be upon him) said to a new Muslim; “O Fudaik establish prayer, pay Zakah and abandon bad deeds and live with your people wherever you like.”

Masnad Imam Ahmad narrated a Hadith that the Prophet (peace be upon him) said: “The countries are Allah’s countries and the people are Allah’s servants, so wherever you find good living environment you may live there.”

I seek Allah’s forgiveness for any and all of my misunderstanding and misdeed. I leave you and your loved ones in the mercy, guidance and protection of Allah The Almighty.

AND ONLY ALLAH KNOWS BEST.

Jazak’Allah Kh’air to Br. Najam A. Najmi.

In brief – What to do in the month of Hajj?

Fasting – Keep fast on the 9th day of the month of Hajj (Wednesday, 19th December 2007)

Glorification of Allah Almighty – From the Fajr prayer of 9th (Wednesday, 19th December) till the Asr prayer of 13th (23 December) day of the month of Hajj, recite the following words 3 times after every fard prayer:

Allahu Akbar, Allahu Akbar - الله اكبر ,الله اكبر

La Ilaha Illallahu, Wallahu Akbar - لااله الاالله والله اكبرAllahu Akbar wa lillahilhamd - الله اكبر ولله الحمد

Sacrifice (Qurbani) – Offer sacrifice of a sheep, lamb or a share in a cow or camel on 10th, 11th or 12th of this month

The month of Hajj, Dhul-hijjah, is the last month of the Islamic calendar. The first ten days of Dhul-hijjah are among the most magnificent days in Islamic calendar.

The Prophet (peace and blessings of Allah be upon him) has said: "There are no days in which righteous deeds are more beloved to Allah than these ten days." The people asked, "Not even jihaad for the sake of Allah?" He said, "Not even jihaad for the sake of Allah, except in the case of a man who went out to fight giving himself and his wealth up for the cause, and came back with nothing." (Reported by al-Bukhari, 2/457).

The virtue of these ten days is based on many things, including:

Allah swears an oath by them, and swearing an oath by something is indicative of its importance and great benefit. Allah says (interpretation of the meaning): "By the dawn; by the ten nights" [al-Fajr 89:1-2]. Many commentators of the Holy Qur’an have said that this verse of the Holy Qu’ran refers to the first ten days of Dhul-Hijjah.

The Prophet (peace and blessings of Allah be upon him) testified that these are the best days of this world, as has been noted above.

Prophet Muhammad (peace and blessings of Allah be upon him) commanded us to devote time to recite Tasbeeh ("Subhan-Allaah"), Tahmeed ("Al-hamdu Lillaah") and Takbeer ("Allaahu akbar") during these ten days. The Prophet (peace and blessings of Allah be upon him) has said: "There are no days greater in the sight of Allah and in which righteous deeds are more beloved to Him than these ten days, so during this time recite a great deal of Tahleel ("La ilaaha ill-Allah"), Takbeer and Tahmeed." (Reported by Ahmad, 7/224; Ahmad Shaakir stated that it is saheeh).

These ten days include Yawm ‘Arafaah (the Day on which the pilgrims stand in the plain of ‘Arafaah), on which Allah perfected His Religion. According to a hadith of the Prophet (peace and blessings of Allah be upon him) "Fasting on this day will expiate for the sins of two years".

These days also include Yawm al-Nahar (the Day of Sacrifice).

Among the good deeds which a Muslim, who has not gone to perform Hajj, during the first ten days of Dhul-Hijjah, should strive to do are:

Fasting

It is Sunnah to fast on the ninth day of Dhul-Hijjah, because the Prophet (peace and blessings of Allaah be upon him) urged us to do good deeds during this time, and fasting is one of the best of deeds. Allaah has chosen fasting for Himself, as is stated in the hadeeth qudsi: "Allaah says: ‘All the deeds of the son of Adam are for him, except for fasting, which is for Me and I am the One Who will reward him for it.’" (Reported by al-Bukhaari, 1805).
The Prophet (peace and blessings of Allaah be upon him) used to fast on the ninth of Dhul-Hijjah. It is reported that the Prophet (peace and blessings of Allaah be upon him) used to fast on the ninth of Dhul-Hijjah, on the day of ‘Aashooraa’, on three days of each month, and on the first two Mondays and Thursdays of each month." (Reported by al-Nisaa’i, 4/205 and by Abu Dawud; classified by al-Albaani as saheeh in Saheeh Abi Dawud, 2/462). According to a hadith, the fast on the ninth of Dhul-Hijjah becomes a cause, hopefully so, of forgiveness for sins committed in one year.

Takbir-ut-tashriq تكبير تشريق

It is Sunnah to say Takbeer ("Allaahu akbar"), Tahmeed ("Al-hamdu Lillaah"), Tahleel ("La ilaha ill-Allaah") and Tasbeeh ("Subhaan Allaah") during the first ten days of Dhul-Hijjah. In particular, it is obligatory (wajib) on each Muslim to recite the Takbir of Tashriq after every fard prayer beginning from the Fajr of the 9th Zulhijjah (the month of Hajj) up to the ‘Asr prayer of the 13th Zulhijjah.

The words to be recited are as follows:

Allahu Akbar, Allahu Akbar - الله اكبر ,الله اكبر

La Ilaha Illallahu, Wallahu Akbar - لااله الاالله والله اكبر

Allahu Akbar wa lillahilhamd - الله اكبر ولله الحمد

(Allah is the greatest, Allah is the greatest, There is no god but Allah, and Allah is the greatest, Allah is the greatest, and to Allah belongs all praise.)

According to authentic Islamic sources, it is wajib on each Muslim, to recite this Takbir after every fard salah, whether one is performing salah with Jama’ah (collectively) or on own (individually). Muslim brothers should recite it in a loud voice, while sisters should recite it in a low voice.

Sacrifice

One of the good deeds that will bring a Muslim closer to Allah during these ten days is offering a sacrifice, by choosing a healthy animal. Sacrifice (or Qurbani, as is known in Urdu) can only be performed during the three days of Eid-ul-Adha, namely the 10th, Ilth and 12th of Dhul-Hijjah. It is only in these days that slaughtering of an animal is recognized as an act of worship. Although sacrifice is permissible on each of the three aforesaid days, it is preferable to perform it on the 10th of Dhul-Hijjah.

Repentance

Repentance means returning to Allah and foregoing all the deeds, open and secret, that He dislikes, out of regret for what has passed, giving it up immediately and being determined never to return to it. We must hasten to repent at once when we have committed a sin, in open or in secret.

A Muslim should ensure that he makes use of this golden opportunity provided by Allaah. May Allah enable us to make use of this opportunity.

If a Muslim wants to offer a sacrifice, he/she should avoid the following things during first ten days of the month of Hajj:

It is a saying of the Prophet (peace and blessings of Allah be upon him) that: "When you see the new moon of Dhul-Hijjah, if anyone of you wants to offer a sacrifice, then he should stop cutting his hair and nails until he has offered his sacrifice." According to another report he said: "He should not remove (literally, touch) anything from his hair or skin." (reported by Muslim with four isnaads, 13/146)

The wisdom behind this prohibition mentioned by the Prophet (peace and blessings of Allah be upon him) is so that a Muslim who has not gone to perform Hajj may resemble those in Ihraam in some aspects of the rituals performed, and so that he may draw closer to Allah by offering the sacrifice. So he leaves his hair and nails alone until the time when he has offered his sacrifice.

Jazak’Allah Kh’air to Br. Shahid Khan.

Entering Ihram

Some pilgrims bypass the designated Meeqat (Station of Ihram) on their route without either being in Ihram or entering into Ihram there, proceeding until they reach Jeddah or some other place, at which they enter into Ihram. This is against the command of Allah’s Messenger (peace be upon him) that every pilgrim should enter into Ihram at the Meeqat which lies on his route. If this be the case withsomeone, he must either go back to the Meeqat lying on his route and enter into Ihram, or he must make expiation by sacrificing a sheep in Makkah and feeding all its meat to the poor.

This applies to all pilgrims regardless of whether one passes the Meeqat by air, sea or land.

If one did not pass through one of the five designated Meeqat points, he should enter into Ihram at a point which is nearest to the Meeqat on his route.

During Tawaf

· Starting the Tawaf at some point other than the site of the Black Stone, while it is obligatory to begin Tawaf from the Black Stone.

· Doing Tawaf inside the Hijr Isma’il, which means going around a portion of the Ka’ba rather than the whole of it since the Hijr Isma’il is a part of the Ka’ba which would then be left out of Tawaf. Such a Tawaf is invalid.

· Doing Ramal (i.e., walking briskly with one’s right shoulder bared) during all seven circuits while Ramal is to be done only during the first three of the Tawaf of Arrival (Tawaf Al-Qudum).

· Pushing and jostling to kiss the Black Stone in this process and hitting people; such acts, which may harm other Muslims, are not permissible.

The Tawaf remains perfectly valid without kissing the Black Stone. If one does not or cannot kiss the Black Stone, it is sufficient simply to point to it – saying "Allahu Akbar" when one comes parallel to it – although one may be at a distance from it.

· Wiping hands over the Black Stone with the "intention of seeking blessings" is an innovation (Bid’ah) with no basis in the Shariah of Islam. The Sunnah is to touch it or kiss it when it can be done easily.

· Touching the four corners of the Ka’ba or its walls, and wiping hands over them. The Prophet (peace be on him) touched only the Black Stone and the Yemeni Corner.

· Reserving specific supplications for each circuit. The Prophet (peace be on him) did not specify any supplications except to say "Allahu Akbar" when he reached the Black Stone and, at the end of each circuit between the Yemeni Corner and the Black Stone, he said:

"Rabbana, Aatina’ Fid-Dunya Hasanatan Wa Fil-Aakhirati Hasanah, Wa Qina Adhaaban-Naar."

(Our Lord, give us good in this world and good in the Hereafter and save us from the punishment of the Fire.)

· Raising one’s voice above the voices of others – whether in following someone or a group or leading the Tawaf as it causes confusion among the worshippers.

· Struggling and hurting other pilgrims to pray at the Maqam (station) of lbrahim. If one is unable to pray behind the Maqam of Ibrahim it is sufficient to pray the two Rak’at of Tawaf anywhere within the Sacred Mosque..

During Sa’ee

· Accelerating one’s pace throughout the entire distance between the two hills. The Sunnah is to accelerate one’s pace only between the two green posts, while walking at normal pace in the remainder of the way.

In Arafat

· Some pilgrims camp outside the boundaries of Arafat and remain there until sunset; then they depart for Muzdalifah without staying at Arafat properly. This is a serious error which invalidates their Haj since the attendance in Arafat is the essence of Haj, and it is obligatory to be within its boundaries and not outside them. If it is not easy to do that, they one may enter before sunset and remain there until sunset. It is quite acceptable to stay in Arafat during the night of sacrifice in particular.

· Departing from Arafat before the sunset is not permissible, because the Messenger of Allah (peace be on him) stayed at Arafat until the sun had set completely.

· Struggling through crowds in order to climb the Mount of Mercy in Arafat is not permissible, because it may harm and causes injuries others. The entire plain of Arafat is a place of attendance, and neither climbing the Jabal Al-Rahmah nor offering Salah there has been recommended.

· Making supplications facing the Jabal Al-Rahmah is incorrect because the Sunnah is to face the Qiblah while supplicating.

· Making heaps of earth or pebbles on the day of Arafat, at particular places has no bases in the Shariah.

In Muzdalifah

· Some pilgrims start collecting pebbles to throw at the Jamarat (Stone Pillars) in Mina as soon as they arrive in Muzdalifah, even before praying the Maghrib and ‘Isha prayers. This is not correct, and so is the practice that all the pebbles must be collected from Muzdalifah (not correct).

The correct position is that the pebbles can be collected from anywhere within the boundaries of Al-Haram. The Prophet (peace be on him) did not ask that the pebbles for Jamrat Al-Aqabah be picked up for him from Muzdalifa.

Throwing pebbles

Some pilgrims are under the impression that when they are throwing pebbles at the Jamarat, they are actually throwing them at the Shayateen (devils). However, the throwing of the pebbles is only a ritual and has been prescribed as a means of remembering Allah the Most High.

Some even throw big stones, shoes or pieces of wood. This is committing an excess in matters of religion which the Prophet (peace be upon him) prohibited. The pebbles should only be as big as good beans.

Crowding and fighting with others at the Jamarat is not permissible. One should be gentle while throwing the pebbles and try as much as possible to avoid hurting others.

Throwing all the pebbles at one time is an error. Scholars have said that this would be counted as only one throw. The Shariah prescribes that the pebbles be pelted one by one, saying "Allahu Akbar" at each throw.

Appointing someone to throw the pebbles on one’s behalf simply due to the fear of crowds or hardship, though the person is capable of doing it himself (is not correct). Only sick or weak individuals are permitted to have someone throw on their behalf.

The Farewell Tawaf

On the day of departure, some pilgrims go to Makkah to perform their Farewell Tawaf before throwing the pebbles at the Jamarat. Then they return to Mina to throw the pebbles, and depart from Mina to their respective countries. Thus their final rite becomes throwing pebbles at the Jamarat and not Tawaf of the Ka’ba. This is an error as the Prophet (peace be on him) said, "No one should depart without his last visit being to the House (Ka’ba)."

Accordingly, the Farewell Tawaf must take place after one has completed all rites of Haj (and before starting his journey for home). After this Tawaf one should not stay in Makkah except for the time it takes to prepare for departure.

After finishing the Farewell Tawaf, some people walk backwards, facing the Ka’ba, as they exit from the Sacred Mosque, under the impression that this is a veneration of the Ka’ba. This is an innovation (Bid’ah) in the religion and has no basis in Islam.

After finishing the Farewell Tawaf, some pilgrims halt at the door of the Sacred Mosque to make supplications. This is also an innovation that has no basis in the Shariah.

Visiting the Prophet’s Mosque

Touching and wiping one’s hands on the walls and iron grilles, tying threads to the gratings, and other acts of this sort while visiting the grave of the Prophet (peace be on him) in order to receive blessings are innovations (Bid’ah). Blessings come from following what Allah and His Messenger (peace be on him) have prescribed, and not from following innovations.

Going to the caves of Mount Uhud or to the caves of Hira or Thaur near Makkah and hanging pieces of cloth or making supplications there have not been prescribed by Allah. All these are unnecessary hardships, innovations in the religion, and have no basis in the Shariah.

Visiting certain sites under the impression that these constitute "relics" of the Prophet (peace be on him), for example: The place where his camel sat, the Well of ‘Uthman or the Well of the Ring, and gathering soil from these places to obtain "blessings," are all innovations.

Calling upon the dead while visiting the graves at the Baqi’ graveyard or the graves of the martyrs of Uhud, and throwing coins in order to seek the blessings of the place or of the people buried there, is a grievous error indeed. (Seeking help from the dead) is Shirk (ascribing partners to Allah the Most High).

It is clear from the Book of Allah and the Sunnah of His Messenger (peace be on him) that all forms of worship must be for Allah alone.

It is not permissible to call upon, offer sacrifice, give vow or any other form of Ibadah (worship) to anyone other than Allah. Allah the Most High, said:

"And they were commanded not, but that they should worship Allâh, and worship none but Him Alone (abstaining from ascribing partners to Him)…"(Qur’an, 98:5)

and He also said:

"And the mosques are for Allah (Alone), so invoke not anyone along with Allah." (Qur’an, 72:18)

We ask Allah, the Most High, to improve the condition of the Muslims and to give them understanding of the religion. and to turn all of us away from errors and deviations. Indeed, He is the All-Hearing, the Ever Responding.

Is it permissible to speak the intention out loud for example when I want to slaughter a sacrifice on behalf of my deceased father and I say, “O Allah, it is the Ud’hiyah for my father [name],” or is it sufficient simply to do the deed without saying anything out loud?.

The seat of the intention is the heart, and whatever a person intends in his heart is sufficient. He should not speak the intention out loud, rather he should say Bismillah and Allaahu Akbar when slaughtering it, because it was proven in al-Saheehayn that Anas (may Allah be pleased with him) said:“The Prophet (peace and blessings of Allah be upon him) slaughtered two rams with his own hand, and he said Bismillah and Allaahu Akbar.” Narrated by al-Bukhari, 7/130, no. 5554; Muslim, 3/1556, no. 1966; Ahmad, 3/115.

There is nothing wrong with you saying, “O Allah, this is a sacrifice on behalf of my father.” This does not mean that you are speaking the intention out loud.

And Allah is the Source of strength.

We would like to point out some things that some people do out of ignorance of the laws of Allaah and the Sunnah of the Messenger of Allaah (peace and blessings of Allaah be upon him). These include the following:

1 – The belief of some that it is prescribed to spend the night of Eid in worship.

Some people believe that it is prescribed to spend the night of Eid in worship. This is a kind of innovation (bidah) that is not proven from the Prophet (peace and blessings of Allaah be upon him). Rather it was narrated in a daeef (weak) hadeeth which says, “Whoever stays up on the night of Eid, his heart will not die on the day when hearts die.” This hadeeth is not saheeh. It was narrated via two isnaads, one of which is mawdoo(fabricated) and the other is daeef jiddan (very weak).See Silsilat al-Ahaadeeth al-Daeefah wa’l-Mawdoo’ah by al-Albaani, 520, 521.

It is not prescribed to single out the night of Eid to pray qiyaam to the exclusion of all other nights, unlike the one whose habit it is to pray qiyaam, in which case there is nothing wrong with him praying qiyaam on the night of Eid.

2 – Visiting graves on the two Eid days.

This is contrary to the purpose of Eid which is to express joy and happiness, and it goes against the teaching of the Prophet (peace and blessings of Allaah be upon him) and the actions of the salaf. It comes under the general meaning of the Prophet prohibition on visiting graves on a specific day and making that like a festival, as the scholars stated. See Ahkaam al-Janaa’iz wa Bida’uhaby al-Albaani, p. 219, 258.

3 – Forsaking the jamaaah and sleeping late and missing the prayer.

Unfortunately you see some of the Muslims missing the prayer and forsaking the jamaaah. The Prophet (peace and blessings of Allaah be upon him) said: “The covenant that stands between us and them is the prayer; whoever forsakes it is a kaafir.” Narrated by al-Tirmidhi, 2621; al-Nasaai, 463; classed as saheeh by al-Albaani in Saheeh al-Tirmidhi.

And he said: “The most burdensome prayers for the hypocrites are the Isha and Fajr prayers. If they knew (what goodness) there is in them, they would come to them even if they had to crawl. I had thought of ordering the call to prayer to be given, then I would tell a man to lead the people in prayer, then I would go, taking some men with me carrying bundles of wood, to people who do not attend the prayer, and would burn their houses down around them.” Narrated by Muslim, 651.

4 – Women mixing with men in the prayer place, the streets and elsewhere, and crowding together with men in those places.

This is a source of great fitnah (temptation) and serious danger. Both women and men should be warned against that, and the necessary means should be taken to prevent that as much as possible. Men and youth should not leave the prayer place or the mosque until after the women have dispersed completely.

5 – Some women going out wearing perfume and makeup, and without veils.

This is a problem which is widespread, and many people take this matter lightly. Allaah is the One Whose help we seek. Some women – may Allaah guide them – even dress up in their finest clothes and put on the best perfume when they go to the mosque to pray Taraaweeh or go to the Eid prayers, etc. The Prophet (peace and blessings of Allaah be upon him) said: “Any woman who puts on perfume and passes by people so that they can smell her fragrance, is an adulteress.” Narrated by al-Nasaa’i, 5126; al-Tirmidhi, 2783; classed as hasan by al-Albaani in Saheeh al-Targheeb wa’l-Tarheeb, 2019.

It was narrated that Abu Hurayrah (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “There are two types of the people of Hell whom I have not seen. People with whips like the tails of cattle with which they beat the people, and women who are clothed yet naked, going astray and leading others astray, with their heads looking like the humps of camels, leaning to one side. They will not enter Paradise nor even smell its fragrance, although its fragrance may be detected from such and such a distance.” Narrated by Muslim, 2128.

The guardians of women must fear Allaah with regard to those who are under their care, and fulfill the duty of protecting and maintaining that Allaah has enjoined upon them, because, “Men are the protectors and maintainers of women, because Allaah has made one of them to excel the other” [al-Nisa’ 4:34]

So they must guide them and show them that which will lead to their salvation and their safety in this world and in the Hereafter, by means of keeping away from that which Allaah has forbidden and striving for that which will bring them closer to Allaah.

6 – Listening to singing and haraam things.

Among the evil things that are widespread in these times is music and singing. They have become very widespread and people take this matter lightly. It is on TV and radio, in cars, homes and marketplaces. There is no power and no strength except with Allaah. Even cell phones are not free of this evil. There are companies which compete in putting the latest music on the ringers of their cell phones, and in this way music has even reached the mosques, may Allaah protect us… This is a great problem and a great evil whereby music is heard in the houses of Allaah.

This confirms the words of the Prophet (peace and blessings of Allaah be upon him), “There will be among my ummah people who will regard adultery, silk, alcohol and musical instruments as permissible.” Narrated by al-Bukhaari.

The Muslim has to fear Allaah and realize that the blessing of Allaah means that he is obliged to give thanks to Him. It is not gratitude for the Muslim to disobey his Lord, when He is the One Who has bestowed this blessing upon him.

One of the righteous passed by some people who were engaged in idle entertainment on the day of Eid and said to them, “If you did well in Ramadaan, this is not the way to give thanks for that. If you did badly in Ramadaan, this is not the way that the one who did badly should behave.”

Allah Ta’ala has made all living creatures out of water. People require water for almost for everything but not all water carries the same value and significance.Muslims refer to the water of Zamzam as something revered and unique. They crave this mysterious liquid and love to drink it whenever they can. And for those who managed to go to the Hajj, they return home carrying it for thousands of miles as a prized possession and to give as special gift to their friends and families.

So what is so special about ZamZam water? In a word: Everything!

There is nothing ordinary about it. The miracle of how it came to being in the middle of a desert, its consistency through out 1000s of years, the beneficial qualities it has, the fact that it never dries up. This water is special.

The fact is, this small and only 5 ft deep well is far away from any other source or body of water. It is self replenishing. It is constantly replenishing itself in order to produce gallons upon gallons of water for the consumption of thirsty pilgrims plus the additional amount that is bottled up and also the amount that is taken as gifts and distributed worldwide to millions. Subhan’Allah!

ZamZam water has scientifically been proven to contain healing qualities due to its higher content of Calcium and Magnesium Salts and also natural fluorides that encompass a germicidal action.

It is also an established scientific fact that pools or water wells tend to grow vegetation such as algae– especially in warm climates. Amazingly this is not the case in the well of Zamzam. It has remained free from biological contaminations.

History of Zamzam Water

Zamzam is the name of a famous well in al-Masjid al-Haraam [the Sacred Mosque in Makkah], which is thirty-eight cubits away from the Ka’bah. It is the well from which Allah quenched the thirst of Ismael the son of Ibrahim (peace and blessings of Allah be upon them both) when he was an infant. His mother (Haajra (peace and blessings of Allah be upon her) looked for water for him, but could not find any. She climbed to the top of Mount al-Safaa, praying to Allah to help her and give her water for Ismael, then she climbed to the top of Mount al-Marwah and did the same. Allah sent Jibreel (peace and blessings of Allah be upon him) , and he struck the earth, and water appeared.

The scholars (may Allah have mercy on them) agreed that it is mustahabb (recommended) for pilgrims on Hajj and Umrah in particular, and for all Muslims in general, to drink Zamzam water, because of the saheeh hadeeth in which the Prophet (peace be upon him) is reported to have drunk the water of Zamzam. (Reported by al-Bukhari, 3/492).

According to the hadith of Abu Dharr (may Allah be pleased with him), the Prophet (peace be upon him) said concerning the water of Zamzam, “It is a blessing, and it is food that satisfies.” (Reported by Muslim, 4/1922).

Al-Tayaalisi added, in a version that he narrated: “and a cure for the sick. – but this is when he drinks it with faith and sincerity, as proven in the hadith of Abu Dharr al-Ghifaari who stayed in Makkah for a month without any nourishment except Zamzam water.

Al-Abbaas ibn Abd al-Muttalib (may Allaah be pleased with him) said: “The people used to compete over Zamzam during the time of Jaahiliyyah (ignorance). People who had children used to bring them and give them to drink, and this was their early-morning victuals. We used to used to think that it was a help for people who had children.”

Al-Abbaas said: “During the Jaahiliyyah, Zamzam was known as Shabaaah (satisfaction).”Al-Allaamah al-Abbi (may Allaah have mercy on him) said: “(The water) is for whatever purpose it is drunk for, and Allaah made it food and drink for Ismaaeel and his mother Haajar.”Ibn al-Mubaarak entered Zamzam and said, “O Allaah, Ibn al-Mu’ammal told me, from Abu’l-Zubayr from Jaabir that the Messenger of Allah (peace be upon him) said: ‘The water of Zamzam is for whatever purpose it is drunk for,’ so, O Allaah, I am drinking it (to quench) my thirst on the Day of Resurrection.”

Virtues and characteristics of the water of Zamzam

The two angels washed the heart of the Prophet (peace be upon him) when he was a child, after they had taken it out, then they put it back. Al-Haafiz al-Iraaqi (may Allaah have mercy on him) said: “The reason why the Prophet chest was washed with Zamzam water was to make him stronger so that he could see the kingdom of heaven and earth, and Paradise and Hell, because one of the special qualities of Zamzam is that it strengthens the heart and calms the soul.

The report about the chest of the Prophet (peace be upon him) being washed with the water of Zamzam is proven in the hadeeth of Abu Dharr (may Allah be pleased with him), who reported that the Prophet (peace be upon him) said: “My roof was opened when I was in Makkah, and Jibreel (peace be upon him) came down and opened my chest, then he washed it with Zamzam water. Then he brought a gold basin full of wisdom and faith, poured it into my chest, and closed it up again. Then he took me by the hand and ascended with me into the first heaven.” (Reported by al-Bukhaari, 3/429).

It is sunnah to drink ones fill of Zamzam water and to quench ones thirst. The fuqaha have mentioned the etiquette that is mustahabb (recommended) when drinking Zamzam water, such as facing the Kabah, saying Bismillah, pausing to take a breath three times, drinking ones fill, praising Allaah after one finishes As regards the hadeeth of Ibn Abbaas (may Allaah be pleased with him), who said, “I gave the Prophet (peace and blessings of Allaah be upon him) Zamzam water to drink whilst he was standing,” (reported by al-Bukhaari, 3/492), it is taken to mean that it is permissible to drink zamzam whilst standing; showing the utmost respect. The scholars also recommended that the person who drinks Zamzam water should sprinkle some of it on his head, face and chest, make lots of duaa when drinking it, and to drink it for a purpose that will benefit him in this world or the next, because of the hadeeth in which the Prophet (peace and blessings of Allaah be upon him) said: “The water of Zamzam is for whatever purpose it is drunk for.” (Reported by Ibn Maajah, 2/1018; see Al-Maqaasid al-Hasanah by al-Sakhaawi, p. 359).

It was reported that when Ibn ‘Abbaas (may Allaah be pleased with him) drank from the water of Zamzam, he said: “O Allaah, I ask you for beneficial knowledge, plentiful provision and healing from every disease.”

Some fuqaha recommended that people should take some Zamzam water back with them to their countries, because it is a cure for those who seek healing. Aaishah (R.A.) reported that she took Zamzam water home with her in bottles, and said, “The Messenger of Allaah (peace and blessings of Allaah be upon him) took some of it away with him, and he used to pour it on the sick and give it to them to drink.” (Reported by al-Tirmidhi, 4/37).

It was reported in Saheeh Muslim that the Prophet (peace and blessings of Allaah be upon him) said to Abu Dharr, who had stayed near the Kabah and its coverings for forty days and nights with no food or drink other than (Zamzam): “How long have you been here?” Abu Dharr said: “I have been here for thirty days and nights.” The Prophet (peace and blessings of Allaah be upon him) said, “Who has been feeding you?” He said, “I have had nothing but Zamzam water, and I have gotten so fat that I have folds of fat on my stomach. I do not feel any of the tiredness or weakness of hunger and I have not become thin.” The Prophet (peace and blessings of Allaah be upon him) said: “Verily, it is blessed, it is food that nourishes.” (Narrated by Imaam Muslim, 2473).

SOME AHAADEETH:

The Prophet (peace and blessings of Allaah be upon him) said: “The best water on the face of the earth is the water of Zamzam; it is a kind of food and a healing from sickness.” (Saheeh al-Jaami’, 3302).

It was reported that the Prophet (peace and blessings of Allaah be upon him) drank it, did wudoo with it and poured it on his head. He used to carry Zamzam water in small vessels and large containers in order to pour it on the sick and give it to them to drink. (al-Silsilat al-Saheehah, 883).

One of the Sahaabah said: we used to call it al-Shabbaaah (satisfying) and it helped us to take care our families (ie. it was filling and helped them to do without food, it was also sufficient to nourish children). (al-Silsilat al-Saheehah li’l-Albaani, 2685).

The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “The water of Zamzam is for whatever it is drunk for.” (Narrated by Ibn Maajah)

The Messenger of Allah, salallahu alayhe wa sallam has said:" The most sublime of all earthly waters is that of ZamZam; therein one finds food for the hungry and medicine for the ill." [ At- Tabarani ]

"Zamzam water is what one intends to drink it for. When one drinks it to be healed, Allah heals him; when one drinks it to be full, Allah makes him full; and when one drinks it to quench his thirst, Allah quenches it. " [ Ahmad, and Ibn Majah]

Since Zamzam water serves whatever purpose and intention for which it is drank; provided it is with sincerity: The scholars and the righteous have tried this and they drank from it with the intention of fulfilling their needs and seeking cure for the sick or relief from poverty or catastrophe and surely Allah eased for them achieving their needs. So next time when one gets the opportunity to drink Zamzam, one should grab the opportunity to pray for: a healthy body, sharp mind, forgiveness for sins, life in Jannah after death, an honorable death on the day of Jummah, and all one’s physical and spiritual needs of this world and Hereafter.

Jazak’Allah Kh’air to Br. Adil.

QUESTION

Assalaamu’alekum,

I have a question about week Hadiths. I recently have joined an Islamic book club and my teacher was giving example of one week Hadith, which is "Jannat lies underneath the feet of mother". She said this is not in major book of Hadith.

I just want to confirm it so I don’t tell other people wrong stuff.

Jazak-Allah

ANSWER

AlHamdu Lillah, Thank you very for your question. It is an important matter and people must know the difference and have enough knowledge of “the Science of Qura’n and Hadith” to pass any judgment or make remarks about any matter in our faith.

Allah The Almighty testifies that the Prophet (peace be upon him) never followed, ordered or did anything but under the guidance of Allah The Almighty, In Surah An-Najm (53:1-5),

“By the Star when it goes down. Your Companion is neither gone astray nor being misled. Nor he says of his own Desire. It is not but inspiration sent down to him (by Allah), He was taught by one Mighty (Angel) in Power (Jibarel AS), Endued with Wisdom (by Allah).”

The again in the same Surah (53:10), Allah The Almighty says;

“So (Allah) conveyed the inspiration to His Servant (Mohammed), conveyed what He (Allah meant) to convey.”

The above ayat teaches us that the Prophet (peace be upon him) said, ordered and practiced everything according to the orders of Almighty Allah. Having said that, the Pious Predecessors and scholars have established a fundamental criteria that anything attributed to the Prophet (peace be upon him) does not contradict the orders of Allah mentioned in Qura’n.

Anything attributed to the Prophet (peace be upon) but (Astaghfirullah) contradictory to Qura’n is a fabrication not a hadith, must be refuted and not followed. Similarly, to attribute false and contradictory statement or traditions to the Prophet (peace be upon him) is also a highly sinful.

There are six most authentic book of ahadith, namely as Saheeh Al-Bukhari, Saheeh Muslim, Sunan Abi Dawood, Jamea At-Tirmidhi, An-Nasai and Sunan Ibn Majah. The work is already done and “a more authentic book cannot be created.” In early days of Islam, the ahadith were compiled according to the transmitters and not by the content (topic). For example, the two authentic collections of ahadith by Sayedina Imam Ahmad Ibn Hanbal (RA) called “Masnad Imam Ahmad” and Sayedina Imam Malik (RA) called “Muwatta” contain ahadith from certain Companions (RAA).

The hadith your teacher mentioned is reported in Sunan At-Tirmidhi, Masnad Imam Ahmed, An-Nasai and Sunan Ibn Majah. The wording is a little different for example;

a) Ibn Majah reported that the Prophet (peace be upon him) said; “A person came to the Prophet (peace be upon him) and asked to participate in a Jihad. The Prophet (peace be upon him) asked the man if his mother is still alive, the man said yes, the Prophet (peace be upon him) said; "Serve her, as at your paradise is at her feet.”

a) At-Tirmidhi reported; “Sayedina Jahmah (RAA) narrated, I asked to take part in a Jihad, the Prophet (peace be upon him) asked me if my mother is alive. I replied in affirmative, the Prophet (peace be upon him) said; Stay with her, for Paradise is beneath her feet.”
I would not speculate what books of ahadith your teacher considers authentic and on what grounds she calls this a weak hadith. This hadith is exactly in light and line with the numerous orders of Almighty Allah in Qura’n about respect of and duties towards parents especially mothers. This hadith appears in three (3) of the six (6) authentic books of ahadith (As-Sahah As-Sittah) and also in Masnad Imam Ahmad, thus meets the criteria for an acceptable hadith.

In response to a similar question, prominent Scholar Shaikh Dr. Muzammil H. Siddiqui said; (Quote)

“Generally, in Islamic law, only the authentic (sahih) and good (hasan) hadiths are used in deriving the rules. The weak (da`if) Ahadith have no value for the purpose of Shariah (means in matters such as implementation of limits, punishment, issue of jurisprudence, etc - Najam). However, the scholars of hadith sometimes differ among themselves in the determination of whether some Ahadith are weak or not. The scholars have sometimes used weak Ahadith for moral and spiritual (Fada’il) matters. It is important that when one uses a weak hadith for any reason, one should explain it to the people that this is weak hadith and that it is being used for this particular reason.
We must also keep in mind that according to the scholars of Hadith (muhaddithin,) the Ahadith are counted according to their chains of narrators (Isnad) and not according to the texts (Matn). Thus one text of a hadith is often found reported through many chains of reporters. Normally the authenticity or weakness of the hadith is checked, not on the basis of its text, but on the basis of its chain (isnad) only. The weakness in a hadith could be due to the lack of continuity in the chain of transmitters or due to the lack of integrity (`adalah) of its narrators. There are various categories of weak Ahadith depending on what part of the chain of transmitters was interrupted and what lack of integrity is detected in a transmitter or transmitters of that particular hadith. It is also possible that a hadith is weak according to one narration (chain of transmission), but its text is found in another better and more sound narration (or the Qura’n itself , like in case of this hadith and the ayat of Qura’n about our duties towards our parents- Najam). Thus the judgment in this matter requires a thorough knowledge of the Hadith literature and methodology.” (End Quote)

In my opinion, we have to be extremely careful in passing decisive remarks on things that we have limited knowledge of, unless our opinion is based on clear guidance from the Qura’n, the ahadith from any of the six authentic books of ahadith or consensus among the Pious Predecessors (RAA). One must have in depth knowledge of Qura’n (including Tafsir), Hadith and its’ Sharh or read, research the writings of pious predecessors and then consult authentic scholars and not the other way around.

I hope this answers your question. I seek Allah’s forgiveness for any and all of my misunderstanding and for all my misdeed in all matters.

I request all of you to forward these replies to your circle of friends and family as you see appropriate. I leave you and your loved ones in the mercy, guidance and protection of Allah the Almighty.

Thank you and WaSalamu Alaikum,

Question:

I have a question regarding blood donation or accepting blood from a non-Muslim. I have been told its Haram for Muslims to donate blood as equivalent to organ donor. I wonder how far it is true? Since non-Muslims eat pork and drink beer is it ok to accept blood from a non-Muslim?

Answer:

First of all we must understand that Allah The Almighty and His Prophet (Peace be upon him) made it obligatory for us to do all we can to save a life"without any prejudice and without jeopardizing another life."

In Surah Al-Maidah 5:32 Allah The Almighty says;

“….and if anyone saved a life, it would be as if he saved the life of all mankind.”

In a Hadith the Prophet (peace be upon him) said; “Allah is on the side of His servants (helps him, etc) as long as the servant is on the side of (helps) his brother (another human being)”.

Prophet (peace be upon him) said; “whoever helps another human with be helped by Allah The Almighty”.

Prophet (peace be upon him) said; “The Most Merciful is Merciful upon those (human) who are merciful upon others (human). Be merciful on those around you on the earth, and The Most Merciful (Allah, Present everywhere) will be Merciful upon you.”

Islam places a great importance on value of life. There is NO differentiation of faith, creed, gender, and color or any other merits or prejudices’ when it comes to saving “ANY LIFE”.

In the light of the above ayah and Hadith donating blood or organs is permissible under certain conditions and limitations, such as;

The organ is taken out only after a competent Doctor pronounces the death of the donor and all efforts to save his/her life have failed

In case of kidney/blood or any other organ transfer, only after a competent Doctor establishes that the suffering person must have a kidney/organ/blood transplant and the donor is a healthy match, and the donor’s life or health would not suffer.

The organ or blood is only used to save another life and not for beautification etc

A decision of the competent Doctors that without the blood transfusion or organ transplant the patient is going to die

The blood or organ is neither sold nor taken by force or under pressure or duress

The donor before his/her death or his/her immediate family agreed to donate the organ/s upon death

Organ can be removed only after all attempts to save the donor’s life are exhausted

Organs are not removed from a living person to help another person without willful consent

Blood or Organ donation is not obligatory or part of faith, if someone is not convinced then there is no sin on him/her for not donating

For example in case of kidney or blood transfusion, if these conditions are followed the life of a suffering person can be saved by a live donor without any significant threat to his own life, because he can still survive on one kidney with slight lifestyle modifications.

We all understand and realize what could happen, if Islamic Shariah and or law allowed transplanting blood or human organs without any condition and or limitations.

In my opinion, organ and blood donation is an act of "Continuous Charity" (Sadaqat Jariyah). During our life time we can donate bone marrow, blood, kidney, tissue, etc to those who are in dire need of whether we personally know the person or not.

It is absolutely impossible and even so “Not Required” to keep the Muslim or Non-Muslim donated blood separately, it is an equal good deed to donate to a Muslim and or a Non-Muslim as long as the blood does not carry any virus or disease. Allah The Almighty did not say that saving a Muslim life is more rewarding than a Non-Muslim life.. Even if we separate the blood on the basis of the donor’s faith, then there would be more issues as people would create further division based on sects, creed, cast, groups, ethnicity, nationality, color, languages, political affiliations, tribal, etc.

As far the organ donation is concerned, there are three opinions. Some scholars maintain that it is allowed only to donate from a dead body and the other scholars say that both living and dead can donate. Islam is the religion of moderation yet a third group of "scholars" say that donation of any organ is mutilation of a human body whether dead or alive.

The third group say that a dead person is not in-charge of his body so neither him nor his relative have any saying. Some say no matter what you do, if a patient is supposed to die of that ailment no one can save it. Most of their arguments make no sense if seen in the light of Qur’an and the practices of the Prophet (peace be upon him) and may even border with lack of religious knowledge.

Following is an opinion from respected Shaikh Dr. Muzzamil Siddiqui, former president of the Islamic Society of North America (ISNA): [Quote]

“This question is very much debated by the jurists in past two decades. The Supreme Council of Islamic Scholars in Riyadh (Saudi Arabia) has allowed both organ donation and organ transplantation only in case of necessity.

The organ can be taken from the body of a living person with his/her consent and approval and also from the body of a dead person. In the case of a living person, the jurists have stipulated that this donation should not deprive him/her of vital organs. It should also not cause risk to his/her normal life.

The Fiqh Academy of the Muslim World League in Makkah AlMukarramah also allowed organ donation and transplantation in its 8th session held between 28 Rabi’ul Thani - 7 Jumadal Oula, 1405 Hijrah.

In 1408 Hijrah, The Fiqh Academy of the Organization of the Islamic Conference in Jeddah also allowed the use of the body organs of a person who has died in an accident, if the necessity requires the use of any organ to cure a patient, provided that a competent and trustworthy physician makes this decision.

It is important to note that most of the jurists have only allowed the donation of the organs. They do not allow the sale of human organs. Their position is that the sale of human organs violates the rules of the dignity and honor of the human being, and so it would be Haram in that case.
Some jurists suggest that because people have become too materialistic and it may not be possible to find a free organ, under necessity one can purchase the organs, but a Muslim should not sell his/her organs.” [End Quote]

In this reply I presented the logical viewpoints. I personally favor the Fiqh Academy’s opinion as saving a life with consent of the blood or organ donor without jeopardizing his own life is of prime importance and one of the highly rewarded acts of humanity.

I hope this provides some answer. I seek Allah’s mercy and forgiveness for any and all of my mistakes and misunderstandings regarding this issue.

I leave you and your loved ones in the mercy, guidance and protection of Allah The Almighty.

AND ONLY ALLAH KNOWS BEST.
